Insurance Coverage Litigation

Our firm practices extensively in both insurance law and litigation, and we are able to bring our experience in both areas to bear on our healthcare clients’ cases involving insurance coverage disputes.  We offer aggressive defense in reservation of rights cases, first-party claims, bad faith claims, declaratory judgment actions and other insurance litigation.  We will also monitor insurance litigation when a conflict of interest prevents an insurer from selecting its own representation.

Deposition Assistance

In addition to preparing witnesses for deposition in cases in which we represent a defendant, our attorneys frequently work with non-party doctors, nurses and other professionals for depositions in cases being litigated by other firms.  We work with medical professionals to help them give calm, clear and honest testimony during deposition and during trial while being mindful of the possibility that they might become a party to the case.

Representative Healthcare Cases

Successful Representation of an Oral Surgeon in IDFPR Proceedings.  After a patient filed a complaint with the IDFPR alleging misconduct by the doctor during a surgical procedure, our health care attorneys conducted a thorough investigation of the claim and presented a strong defense in support of the doctor showing that the claims had no merit.   The IDFPR agreed with our position and dismissed the complaint and terminated the proceedings against the doctor.

Favorable Resolution of Multiple Claims against a Pharmacy Client following Medication Compounding Error.  After multiple plaintiffs filed lawsuits against our pharmacy client asserting complications and injuries following receipt of morphine medication for use in intrathecal pain pumps, which sought millions of dollars in damages, our health care attorneys undertook the defense of those claims.  After determining that there had been a compounding error in mixing the medication, our client admitted liability but denied that plaintiffs had been injured or damaged to the extent claimed.  Following extensive investigation of the plaintiffs’ injury claims, including review of thousands of pages of medical records and numerous depositions of various treating physicians and experts, the plaintiffs significantly reduced their demands resulting in settlement of the claims on very favorable terms for our pharmacy client.

Successful Negotiation of Separation Agreement on Behalf of Physician.  After continued disagreements between our client physician and the corporate medical group which employed him, we engaged in negotiations with the medical group for termination of the employment relationship, including a release from a restrictive covenant covering the physician, which allowed the physician to establish his own medical practice in the same community and which allowed him to continue to treat his patients without interruption.
