Quinn Johnston investigates each legal negligence case thoroughly to determine if an attorney-client relationship existed, if there was a breach of duty of care, if the plaintiff suffered any actual damages, and if the alleged breach of duty proximately caused plaintiff’s damages.  When a plaintiff alleges legal malpractice in litigation (the so-called “case within a case”), we also investigate if the plaintiff had any chance of recovering damages in the original lawsuit.  Unless a plaintiff can prove he or she would have recovered damages in the original lawsuit, it can be difficult to recover damages in a legal negligence suit.

Our firm can also assist attorneys with responses to complaints made to the Attorney Registration & Disciplinary Commission (ARDC) and can also represent attorneys during hearings before the ARDC.

Defense Against Accountant Malpractice Claims

Quinn Johnston also represents accountants accused of negligence.  These claims often involve allegations that an accountant made an error while conducting an audit, gave bad advice, or made mistakes while preparing tax returns (often discovered during IRS audits).  Claims may allege that an accountant failed to follow GAAP (Generally Accepted Accounting Principles) or GAAS (Generally Accepted Auditing Standards).
